The terms in this policy which relate to Privacy apply to all natural persons whereas the provisions in clause 10 which relate to Electronic Messages apply to all persons.

PRIVACY

1.       General

Your privacy is important to Turners Group NZ Limited (Turners).  We take our privacy seriously and comply with all applicable privacy laws, including the Privacy Act 2020.

This privacy policy outlines how Turners (“we”, “us”, “our”) collect, use, hold and share your personal information.   Personal information is information about you as an individual.

The Office of the Privacy Commissioner (www.privacy.org.nz) provides further details of the Privacy Act and how it protects personal information in New Zealand.

1.       Information that we collect

We collect personal information that you provide to us directly, including when you interact with our staff or contact us (by email, phone, through social media or otherwise) and when you use our websites.

We generally record inbound and outbound telephone calls for operational purposes such as complaint handling and reporting, quality assurance and staff training.

From time to time, Turners may need to obtain information regarding names and addresses of registered owners, vehicle information and history from NZ Transport Agency (Waka Kotahi), to be used for the purpose of verifying ownership details of a vehicle.  You have the right to notify Waka Kotahi if you do not wish to have your names and address made available under an authorisation.  Turners holds an authorisation from Waka Kotahi under section 241(1) of the Land Transport Act 1998.

·       The types of personal information we collect from you will depend on the nature of our interactions with you and the circumstances in which your personal information is collected.  The personal information we collect from you may include: your name, email address and other contact details;

·       identification details including driver’s licence information;

·       motor vehicle details;

·       financial information;

·       personal information including date of birth, gender, residency;

·       information related to credit worthiness;

·       billing and payment information.

If you choose not to provide us with any personal information that we ask for, we may not be able to respond to our request or answer your queries, or provide you with our products and services.

Sometimes we may collect your personal information from sources other than you.  These include publicly available sources (such as the New Zealand Motor Vehicle Register) and, where we have your consent, other third parties or other companies in our group.

If you are going to do a test drive we will require your driver’s licence.

2.       Web measurement tools and cookies

Turners employs web measurement tools to collect personal information.

This information covers:

·       Technical Information: IP address, device type, operating system, browser type, screen resolution, language settings.

·       Browsing Behaviour: Pages visited, links clicked, search terms used, time and date of visit, duration of visit, website visited before arriving at the site.

·       Location Data: Sometimes, general location data (e.g., country) might be collected.

·       Cookies and Tracking Technologies: Information about the use of cookies, web tags, and similar technologies.

The information is used for:

·       Website Improvement: Understanding how users interact with the website to improve its functionality, design, and content. For example, identifying popular pages or areas where users encounter difficulties.

·       Website Analytics: Gathering statistical data on website traffic, user demographics (often anonymized and aggregated), and browsing patterns.

You have the right to ask us for access to and request correction of, the personal information we hold about you by contacting us at privacy@turners.co.nz . We will respond to your request in accordance with the requirements and processes set out in the Privacy Act 2020.,

 

4.       Changes to the Privacy Policy

Turners may, from time to time and in its sole discretion, modify, alter or otherwise change this policy with or without notice to you. All such changes will be effective immediately upon the updating of the policy on our website.

 

5.       What we use your information for

We may use your personal information to:

·       provide you with our products and services 

·       respond to your requests, answer your enquiries and communicate with you; 

·       where we have your consent, send you messages about our products and services or the products and services of our group companies that you might be interested in, by email and text message; 

·       send you newsletters and customer surveys post-sale;  

·       improve our products and services;

·       conduct market research and statistical analysis;

·       consider your application for an accout or services, to verify your identiy and assess your creditworthiness and financial position;

·       exercise our rights and fulfilling our obligations under any agreement with you;

·       to operate the Turners websites and deliver the services you have requested;

·       For any purpose required or authorised by law; and

·       For any other purpose that we notify you of when collecting your personal information. 

You can change the settings on your browser to be incognito or private and/or disable cookies while you are using our websites to avoid the measurement above.

 

6.       Sharing your personal information

Turners does not sell, rent or lease its customer lists to third parties.

We may share your personal information with:

·       our service providers and suppliers;

·       our parent company, Turners Automotive Group Limited;

·       our group companies, but only if you consented to us sharing your information with them;

·       any other party or type of party that we notify you of when collecting your personal information;

·       lenders and insurers, but only if you have consented to us sharing your information with them;

·       government agencies and regulators, or any else, if we are required to share that information for the purposes of complying with applicable law and regulations.

 

7.       Security

We ensure the personal information we hold about you is protected against misuse and unauthorised access, disclosure or alteration by reasonable security safeguards.

However, when you use our websites, there may e links to other third-party internet sites.  Please be aware that your use of such third -party sites will not be subject to the terms of this Privacy Policy.

9.       Electronic Messages

By agreeing to these website terms and conditions and providing your email address or phone number, you consent to Turners sending you marketing messages relating to our products and services, and sending your information to our group companies so that they can send you marketing messages relating to their products and services, by email, phone and text message.

Every unsolicited message which Turners sends you containing information will include an unsubscribe facility which will remove your email address from Turners database within 5 working days of Turners receiving your unsubscribe request.

Removal of Your Email Address: You may request that Turners delete your email address at any time by either contacting Turners in writing, email or using the functional unsubscribe feature on an email you may have received from Turners.
